Injured In A Car Accident?
Have you been in a car accident where you are not at fault? Illinois and Wisconsin law provides legal protection that will help you recover damages in the event of a car accident. At Heller Trakhtman & Associates they are there to help you with the legal process.
How To Report A Car Accident
Did you know that in the event of a car accident, you are required by Illinois law to report it, if the accident causes death or injury or does more than $1,500 of property damage? Accident report forms can be provided by the responding officer or obtained at the local police station and should be filed online within 10 days of the accident. Failure to report an accident within 10 days can result in the suspension of your license. Lawsuits must be filed within two years for accidents that cause personal injury and within five years for accidents that cause property damage.
In the event of an accident where you believe the other driver is negligent, you can file a lawsuit and be compensated for economic and noneconomic damages. Economic damages are defined as property damage to your vehicle, medical expenses and future medical expenses, lost income and additional out-of-a-pocket expenses. Noneconomic damages include pain and suffering, emotional distress, loss of consortium and additional nonmonetary losses.
To prove that a driver is negligent in a car accident, the case must fit three criteria:
- The other driver did not fulfill their owed duty to drive with a reasonable degree of care
- The other driver failed to drive with a reasonable degree of care that resulted in your accident, for example if the driver was texting while driving
- You suffered economic or noneconomic damages due to the driver’s actions that caused the accident
